- the content, features, and services provided by Conteur de Vitesse (“Services”),
- the publisher Conteur de Vitesse (“Publisher”),
- and to define the conditions of access and use of the services by the “User.”
These GTU are accessible on the website under the “GTU” section.
Any use of the website shall be deemed to have taken place on French or European territory. French law applies to this contract. In the absence of an amicable resolution of a dispute arising between the parties, French courts shall have exclusive jurisdiction to hear the matter.

ARTICLE 2 – DEFINITIONS
For the purposes of these GTU, the following terms are defined as follows:
- Beneficiary: Conteur de Vitesse
- Personal Data: Refers to any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to their physical, physiological, genetic, mental, economic, cultural, or social identity.
- Publisher: Refers to “Conteur de Vitesse”
- Data Protection Regulations: Refers to all applicable laws and regulations concerning the protection of personal data, including the General Data Protection Regulation 2016/679 and the French Data Protection Act of January 6, 1978, as amended. If the User resides in an European Union country, the applicable regulations of their country of residence apply.
- Users: Refers to any authorized user accessing and using the services of “Certifik.io.”
- Service Providers: Refers to any service provider authorized by the Beneficiary to provide the services offered by “Certifik.io.”
ARTICLE 3 – CERTIFIK SERVICES
3.1 Access to Services
“Certifik.io” is exclusively accessible to the Beneficiary, the service providers designated by the Beneficiary, and in particular the Users it authorizes. In any case, the Beneficiary reserves the right to grant access to “certifik.io” to any person of its choice, subject to compliance with these GTU.
To access the Services, Users may be required to complete certain mandatory fields accurately, as indicated by the Beneficiary for this purpose.
Users guarantee that they will not upload, provide, or publish in any way on “Certifik.io” any offensive, illegal, or harmful information that could infringe on the rights, harm, or threaten the safety of any person.
3.2 Services Offered by the CERTIFIK Website
The services accessible from the “certifik.io” website may vary depending on the plans offered by the Beneficiary.
3.2.1 Certification Service
The “Certifik.io” website provides Users with access to the following services: document certification on the Algorand blockchain.
The website is freely accessible anywhere to any User with an internet connection. All costs incurred by the User to access the services (computer hardware, software, internet connection, etc.) are at their own expense.
Non-member Users do not have access to reserved services. To access these, they must register by completing the form. By agreeing to register for reserved services, the member User undertakes to provide accurate and truthful information regarding their identity and contact details, particularly their email address.
Any breach of this commitment will engage the User’s liability and release “certifik.io” from any liability toward third parties.
To access the services, the User must then log in using their username and password, which will be provided after registration.
Any regularly registered member User may also request to unsubscribe by visiting the dedicated page in their personal account. This will take effect within a reasonable timeframe.
Users can contact the website via email at the Publisher’s email address provided in ARTICLE 1.
3.2.2 Authentication Service
The “certifik.io” website provides Users with access to the following services: document authentication on the Algorand blockchain and through the service provider.

ARTICLE 4 – PROTECTED RIGHTS
All content uploaded by Users to “Certifik.io” is the exclusive property of the User.
Access to “certifik.io” grants the User a personal, non-transferable, and non-exclusive right of use.
PFertile to Article L.122-4 of the French Intellectual Property Code, any representation, reproduction, extraction, or exploitation not expressly authorized by the Beneficiary, or where applicable, the User, whether in whole or in part, free of charge or for a fee, by any means whatsoever, would be unlawful and constitute an infringement punishable under Articles L.335-2 et seq. of the Intellectual Property Code.
“Certifik.io” and the various logos and names present on “Certifik.io” are registered or protected under the provisions of the Intellectual Property Code, and their reproduction without prior written authorization from their owner would also constitute an infringement.
Trademarks, logos, signs, and all website content (text, images, sound, etc.) are protected under the Intellectual Property Code, particularly by copyright law.
The CERTIFIK trademark is a registered trademark of Conteur de Vitesse. Any representation, reproduction, or partial or total exploitation of this trademark, of any kind, is strictly prohibited.
The User must obtain prior authorization from the website for any reproduction, publication, or copying of the various contents. They undertake to use the website’s content strictly within a private framework, and any use for commercial or advertising purposes is strictly prohibited.
Any total or partial representation of this website by any means whatsoever, without the express authorization of the website operator, would constitute an infringement punishable under Article L.335-2 et seq. of the Intellectual Property Code.
It is recalled, in accordance with Article L.122-5 of the Intellectual Property Code, that a User who reproduces, copies, or publishes protected content must cite the author and their source.
ARTICLE 5 – AVAILABILITY
“Certifik.io” is accessible 24/7, except in cases of interruption, scheduled or unscheduled, for maintenance, updates, or force majeure.
Being subject to an obligation of means, neither the Publisher nor the Beneficiary can be held liable by Users for any damage, regardless of its nature, resulting from unavailability.
ARTICLE 6 – NAVIGATION
It is the responsibility of Users to ensure that the browser they use allows access to the Services, where applicable, in a secure configuration. Likewise, before using the Services, Users must ensure that their browser’s cache has been cleared to ensure that accessible pages are up to date.
6.1 Connection Data
“Certifik.io” automatically collects certain data about Users, such as the Internet Protocol (IP) address of the computer used, the IP address of the internet service provider, the date and time of access to the website, the operating system used, the pages visited, and the information downloaded. This data may be used for system administration and to improve the Services and is retained for a period of one year.
6.2 Cookies
Users are informed that during their visits to the website, a cookie may be automatically installed on their browsing software.

6.3 Hyperlinks / Third-Party Content
The presence of links to third-party websites or access to third-party content via “Certifik.io” does not constitute a recommendation or endorsement of these websites or their content. It is the User’s responsibility to refer to the terms of use of said websites. Users are informed that clicking on these links will take them away from the “Certifik.io” website.
The Publisher and the Beneficiary cannot be held responsible for the content, products, services, advertising, cookies, or any other element of these websites, nor for any damage or loss, proven or alleged, resulting from or related to the use of information, opinions, services, or data available on these websites.
ARTICLE 7 – PERSONAL DATA
Users are informed that the Beneficiary collects and processes Personal Data concerning them (identification data, professional data, connection data) based on the use of “certifik.io,” in accordance with the purposes defined below, necessary for the performance of the Services:
- Document certification and contractualization
- Document authentication and contractualization
Personal Data originates from Users, the Beneficiary, or information generated during the use of “certifik.io.”
It is accessible to personnel authorized by the Beneficiary who need to know it for their activities, including service providers, “certifik.io” administrators, and any other authorized personnel of the Publisher.
Furthermore, Personal Data may be disclosed to any person or public or private entity, including administrative authorities, when such disclosure is required by law.
The Beneficiary informs Users that Personal Data is not transferred to third parties, except for service providers under its responsibility.
Personal Data of non-client Users (simple website visitors) will be retained on “certifik.io” for a period of 3 months from the start of interactions with the Beneficiary.
Personal Data of client Users (those who have subscribed) will be retained on “certifik.io” for the duration of the contract with the Beneficiary and for a period of 3 months after the User’s termination of the contract with the Beneficiary.
In accordance with Data Protection Regulations, Users may exercise their rights to access, rectify, object for legitimate reasons, restrict processing, or request data portability regarding the personal information processed as part of the Services by submitting a request, accompanied by a copy of an identity document, to the competent department of the Beneficiary, whose contact details are provided in ARTICLE 1.
Users may also submit instructions to this department regarding the handling of their Personal Data in the event of death, particularly the desired manner for exercising the aforementioned rights.
ARTICLE 8 – LIABILITY
The Beneficiary, the Publisher, their executives, and/or service providers cannot be held liable for any damage whatsoever arising from a connection to and/or use of “certifik.io” and/or the Services.
The sources of information published on the “certifik.io” website are deemed reliable, but the website does not guarantee that it is free from defects, errors, or omissions.
The information provided is for indicative and general purposes without contractual value. Despite regular updates, the “certifik.io” website cannot be held liable for changes in administrative or legal provisions occurring after publication. Likewise, the website cannot be held liable for the use or interpretation of the information contained on this website.
The User is responsible for keeping their password confidential. Any disclosure of the password, in any form, is prohibited. The User assumes the risks associated with the use of their username and password. The website disclaims all liability.
The website’s liability cannot be engaged in cases of force majeure or unforeseeable and insurmountable acts of a third party, such as hacking or data loss attributable to the hosting provider.
ARTICLE 9 – CONFIDENTIALITY OF IDENTIFIERS AND ACCESS CODES
Users are granted identifiers and access codes necessary for connecting to the Service (“Identifiers”) for the use of “certifik.io.”
These Identifiers are strictly personal, non-transferable, confidential, and under the responsibility of the Users. Users undertake not to disclose them to third parties and to take all necessary measures to ensure and maintain their confidentiality.
Any access to a Service, its use, or any operation carried out through it using a User’s Identifiers will be deemed to have been performed by the User. The User remains solely responsible for the use of their Identifiers.
In the event of non-compliant use of Identifiers, access to “certifik.io” for Users may be suspended without prior notice or formality and without entitlement to compensation for any prejudice.
Users undertake to:
- Immediately inform the Beneficiary of any unauthorized use or knowledge of the Identifiers by a third party and the circumstances leading to such use or knowledge.
- Actively cooperate to put an end to such unauthorized use or knowledge.
ARTICLE 10 – CONFIDENTIALITY OF COMMUNICATIONS VIA THE INTERNET AND OTHER NETWORKS
Since communications via the Internet and other telecommunications networks (particularly when accessed via mobile connectivity devices) are not secure by default, neither the Beneficiary nor the Publisher can be held liable for any intentional or unintentional interception by a third party of any message and/or information exchanged between the Beneficiary and a User.
ARTICLE 11 – ACCEPTANCE, REFUSAL, AND MODIFICATION OF THE GTU
Users may only access “certifik.io” after fully and unconditionally accepting these GTU.
During registration on the website via the registration form, each User expressly accepts these GTU by checking the box next to the text: “I acknowledge that I have read and understood the GTU and accept them.”
In case of non-acceptance of the GTU stipulated in this contract, the User must refrain from accessing the services offered by the website.
“certifik.io” reserves the right to unilaterally modify the content of these GTU at any time.
If a User disagrees with any provision of the GTU, they must not use “certifik.io.”
The refusal option is available under the GTU. This principle corresponds to the right to object. Refusing the GTU triggers an objection to the use of “certifik.io.” In this case, connection to the website for a User is no longer possible. They must contact the Publisher if they wish to connect due to a change of mind.
In case of modification of the GTU, these will be brought to the attention of Users to obtain their consent.
